OVI and DUI Advice and Suggestions
The Initial Traffic Stop
- Do not take a field sobriety test; there are no requirements for taking this test. The results of this test can lead your being arrested and charged.
- Do not take a portable breathalyzer; the results of the portable test are not admissible into evidence and there is no penalty for denying it.
- Do not go the hospital to seek medical attention, at this point they could take a blood test which would probably be admissible based on medical necessity.
- Do not discuss what if anything you had to drink that day with the arresting officer, this information will lead to arrest and charge with DUI/OVI.
- If you’re taken to the Police Station, call an attorney before you take a breathalyzer or urine test. When speaking to your attorney make sure you only response are yes and no, because police officers might be listening to your conversation. For example, before your attorney can advise you on how to proceed, he or she must know how much you had to drink. They will ask you numbers and your only answer should be yes and no.
